Service use agreement
Chapter I General Rules

Article 1 (Purpose)
The purpose of this service agreement is to prescribe basic matters for the use of Internet-related services provided by the company (hereinafter referred to as the "company"), such as rights, duties, and responsibilities between members and the company, and conditions and procedures for use integrated into one ID and PASSWORD

Article 2 (The validity and change of the terms and conditions) 
① This Agreement shall take effect for all members who would like to use the service. However, it will take effect with the terms and conditions of use for the members who are the online customers of JK Plastic Surgery website.
② The contents of these terms and conditions shall be posted on the service screen or noticed to the members by other methods, and it takes effect when members who agree to them join the service.
③ The company may change these terms and conditions if recognized necessary, and if the company changes the terms and conditions, it shall specify the date of application and the reason for the change and notify them 15 days prior to the date of application in the same way as in paragraph 2. However, if the terms and conditions that are unfavorable to the members are changed, the members shall be notified 30 days prior to the application date and the members shall be notified individually by e-mail, etc. (If individual notice is difficult due to the member's non-existing contact information, contact information change, etc., it is regarded that the individual notice have been made by notice as in this paragraph.) 
④ When the company announced or notified the terms and conditions of change according to the paragraph 3, if the member does not express his/her intention to reject the terms and conditions of change explicitly, although it has announced or notified the member that it is regraded that he/she has agreed to the terms and conditions of change if the intention of refusal is not expressed by the date of application of the terms and conditions of change, the member shall be regraded that he/she has agreed to the terms and conditions of change. If the member disagree to the changed terms and conditions, the member may discontinue the service use and terminate the service contract.

Article 3 (Regulations other than Terms and Conditions)
Matters not specified in these terms and conditions shall be governed by the relevant Act and subordinate statute, such as the Framework Act on Telecommunications and the Telecommunications Business Act, and by the regulations such as detailed guidelines for the service use prescribed by the company.

Article 4 (Definitions of Terms) 
① The definitions of terms used in these terms and conditions are as follows.
    Member: customer who has accessed the site and has agreed to these terms and conditions and has been issued an ID and password. The qualifications, authority, etc. of members are managed separately by site.
    ID : only one ID can be issued and used in combination of alphabetical characters and numbers selected by the member and approved by the company for member's identification and the service use.
    PASSWORD : combination of characters and numbers set by the member for information protection.
    System operator : person selected by the company for the overall management and smooth service operation.
    Service suspension: suspending service provision for a certain period of time in according to the certain requirements set by the company during normal use.
② Except as specified in paragraph 1, the definitions of terms used in these terms and conditions shall be governed by the relevant Act and subordinate statute and the guidance of each service.

Chapter 2 Service Use Agreement

Article 5 (service contract Formation)

① If the customer presses the "Agree" button to the question when application for use, "Do you agree to the above terms of use?", it will be regarded to agree to the terms and conditions.
② The service contract is established by the company's approval of the customer's application for use.

Article 6 (Application for Use) Application for use is made by the customer filling in the following items in the subscription form on the service user registration screen. Name, ID, Password, Address, Mobile Number, Phone Number, E-mail Address

Article 7 (Approval of Application for Use) 
The company approves the application for service use to the customers who applied for the service by accurately filling in the matters specified in Article 6.

Article 8 (Limitations of Aproval of Application for Use) 
① The company may not approve applications the following applications.
   - In case that the service is not technically available
   - In case of false application at the time of user registration, such as false name or use of other person's name 
   - In case that the user registration matters are omitted or miswritten at the time of registration
   - In case of offending or for the purpose of offending against the peace and order or public morals of society at the time of registration
   - In case that a person has previously lost his or her qualification for membership under Article 24 paragraph 2. However, the case that a person who has passed more than one year after the loss of the same qualification has received the approval of the company's membership re-admission is an exception.
   - In case that other qualifications for application for use as decided by the company are not satisfied

Article 9 (Change of Contract) 
In the case of member's application for use, modification shall be made in according to the form and method decided by the company, if the details filled in are changed.


Chapter 3 Use of Service

Article 10 (Start of Use of Service) 

① The company starts the service from the time the member's application has been approved. However, some services will be started from the specified date.
② If the service cannot be started due to the business or technical failure of the company, it shall be announced on the website or notified to the members.

Article 11 (Service hours) 
① The service is 24 hours a day in principle. However, the service may be suspended due to the company's business or technical reasons, and the service may be suspended for a period set by the company for operational purposes. In such cases, the company shall notify it in advance or later.
② The company may separately decide the available time for each range by dividing the service into a certain range, and in such cases, the company shall notify it in advance or later.

Article 12 (Change and Suspension of Service) 
① The company may notify the members of the details and providing date of the service to be changed by the method specified in Article 22 to change and provide the service.
② The company may limit or suspend all or part of the services in following cases.
   - In case of unavoidable circumstances due to construction, such as maintenance of service system
   - In case that the member interferes with the company's promotional activities
   - In case of a disruption to normal service use due to blackout, failure of various systems, or excessive use, etc. 
   - In case that the service cannot be maintained due to various circumstances by the company, such as termination of a contract with the service provider
   - In case of others such as unavoidable circumstances including natural disasters or national emergencies
③ In case of a service suspension under paragraph 2, the company shall notify the users by the method specified in Article 22. However, this is not the case where prior notice is not possible due to the company's service suspension due to uncontrollable reasons (operator's intention, faultless disk failure, system down, etc.).
④ The company shall not take any responsibility for any problems occured from the change or suspension of the service.

Article 13 (Members' Duties and Responsibilities for E-mail) 
① The company may provide e-mail services for each site to members. The company does not edit or monitor the members' e-mail contents, and each member is responsible for the contents of the e-mail.
② The members shall not send pornography, disturbing contents, junk mail, spam mail, chain letters, etc. through the company's email, or e-mail recommending pyramid system or causing other people or traditional custom harm.
③ The member is fully liable for the occurred violation of paragraph 2 of this Article , and in such cases, the company may provide the member's ID and password to the investigative authority.

Article 14 (Members' Duties and Responsibilities for SMS Transmission) 
① SMS can be transmitted to members for reservation notification service. However, it may be limited by agreement with the member.

Article 15 (Provision of Information and Advertising Posts) 
In operating the service, the company can provide information related to the company's information service on on reservation by e-mail, letter mail, SMS, and etc.

Article 16 (Deletion of the Posts or Contents) 
① The company may delete all contents of the service (including messages among the members) posted or delivered by the member without prior notice if it is regarded to correspond to the following cases, and the company shall not be liable for the deletion:
   - In the case of contents that slander or injure honor of the company, other members, or third parties by slandering
   - In case of circulation of information, sentences, shapes, etc. offending against the public morals
   - In case of violating other rights, such as copyright of the company and third parties, etc
   - In case the posting period prescribed by the company according to the detailed use guidelines specified in paragraph 2 is exceeded
   - In case the content is not related to the service provided by the company
   - In case of posting unnecessary or unauthorized advertisements or promotional materials
   - In case it's regarded to be in violation of relevant Act and subordinate statute and company guidelines
② The company may separately decide and implement detailed guidelines for use related to the posts, and the members shall post or delete various postings (including messages among the members) according to the guidelines.

Article 17 (Copyright of Post) 
① The copyright of the posts by members in service (including messages among the members) is owned by the each member and the company has the right to post them in the service.
② The company shall not use the posts for any other purpose without the consent of the posted member.
③ The company shall not assume the civil and criminal liability for any post posted by the member in the service, even if they violate other people's copyrights, program copyrights, etc. If the company receives an objection, such as a claim for damages, etc., from others due to member's violation of copyright or program copyright of others, the member shall endeavor for the company to be exempted from obligation, and if the company is not exempted from obligation, the member shall indemnify for all damages incurred.
④ The company may delete the posts posted by the member if the member voluntarily cancels or is terminated due to legitimate reasons.
⑤ Copyright to the work posted by the company belongs to the company itself.
⑥ The member shall not use the information posted on the service for profit, such as the act of processing or selling information obtained during using the service, or allow third party to use, and the copyright violation to the post shall be governed by the relevant Act and subordinate statute.



Chapter 4 Duty of the person in charge of membership

Article 18 (Duties of the Company)
① The company shall not disclose or distribute the members' personal information that it knows related to the service provision to third parties without the members' consent. However, exceptions are cases for legal procedures in accordance with the provision of law, such as request from organs concerned for investigation purposes under relevant Act and subordinate statute or request from the Korea Internet Safety Commission.
② Within the range of paragraph 1, the company may prepare and use statistical data on the personal information of all or part of the members without prior consent of the members in connection with the work and may send cookies to the members' computers for the purposes. In this case, the member may change the browser setting on the computer to reject the reception of cookies or to warn against the reception of cookies, and members are liable for changing the service use due to the change in the cookie settings.
③ The company shall promptly handle complaints from members related to the service, and if it is not possible to handle them promptly, it shall post the reasons and the processing schedule on the service screen or notify the members through e-mail.
④ In case a member is damaged by the service provided by the company, the company shall be liable only if such damages are caused by the company's intention or gross negligence, and the range of responsibility is limited to ordinary damages.
⑤ The company complies with regulations related to the operation and maintenance of the service, such as the law regarding the promotion of information and communication network use and protection of information, and the Protection of Communications Secrets Act.

Article 19 (Duties of Members)
① Member shall not do any of the following acts when using the service.
   - The act of writing false information when applying or change of use, or stealing and using other member's ID and password illegally
   - The act of duplicating or distributing information obtained by using the company's service information without prior consent of the company, or using it commercially
   - The act of damaging the honor of others or giving disadvantages 
   - The act of posting pornography on noticeboard, etc. or connecting (linking) pornographic sites
   - The act of violating other rights, such as copyright of the company and third parties
   - The act of circulating information, sentences, shapes, and voices in violation of public order and public morals to others
   - The act of registering or distributing computer virus-infected data that causes service-related false system operation and destruction and confusion of information
   - The act of transmitting information that may intentionally disrupt the service operation or may disrupt the stable service operation , and advertising information contrary to the receiver's overt refusal of the reception
   - The act of pretending to be other person and falsely stating the relationship with other person
   - The act of collecting, storing, and disclosing personal information of other member
   - The act of circulating false information for the purpose of giving benefits of property on oneself or others or harming others
   - The act of gambling or doing speculative behavior by offering properties 
   - The act of recommending prostitution or circulating information that mediates sexual activity
   - The act of continuously sending a word, sound, text, video, or picture that causes shame, disgust, or fear to the other party to distrupt the daily life
   - The act of changing information posted on service
   - The act of transmitting or posting information (including computer programs) that is prohibited from being transmitted or posted under relevant statutes 
   - The act of posting or sending mail by pretending or impersonating company's employee or operator, or by stealing the name of others - Posting materials or sending materials by e-mail including software viruses, other computer codes, files and programs designed to disrupt or destroy the normal operation of computer software, hardware and telecommunications equipment
   - The act of harassing other members, such as stalking
   - Other act of illegal or unreasonable
② The member shall comply with the relevant Act and subordinate statute, the regulations of this terms and conditions, the use guide and the precautions announced in the service and matters notified by the company, and other acts that distrupt company's work are not allowed.
③ Except as officially recognized by the company, the member shall not engage in sales activities using the service, especially hacking, profits from advertising, commercial activities through pornographic sites, and unauthorized distribution of commercial software. The company shall not be liable for legal actions, such as the results and losses of sales activities and the imprisonment by organs concerned, and the member ought to pay damages to the company in connection with such actions.
④ When a member registers for service use, he/she shall provide complete information (hereinafter "registration information") in accord with the current facts.
⑤ The member shall update the registration information immediately if there are any changes occured. If the registration information provided by the member and the updated registration information are incorrect, or if a member commits an act specified in paragraph 1 of this Article, the company may limit or suspend the member's service use under Article 24 of this service agreement.

Article 20 (Duties and Responsibilities for Member ID and PASSWORD Management)
① The company shall thoroughly manage the member ID and password when the service use in the site.
② The member himself/herself is responsible for all results caused by neglect of management of the member ID and password, and by wrongful use. However, the company shall be liable for the problems caused by the company's faults, such as system failure.
③ The company recommends changing the password every three months for the safe protection of the members' personal information and provides technical measures for this purpose. The member can change the password every three months accordingly.
④ The member shall not allow a third party to use his/her ID and password, and shall notify the company immediately if he/she recognizes that his/her ID and password have been stolen or used by a third party, and shall comply with the company's instructions accordingly.
⑤ The member's ID cannot be changed without prior consent of the company.

Article 21 (Notice on Members) 
① In case of notification on a member, the company may use the email address or SMS registered by the member. 
② In the case of notification on many and unspecified members, the company can substitute for individual notification by posting it on the service noticeboard.

Article 22 (Protection of Users' Personal Information)
The company endeavors to protect the member's personal information, including member registration information, according to the relevant statutes. The protection of member's personal information shall be governed by the relevant statutes and "Privacy policy" by the company.

Article 23 (Commission of Personal Information)
In principle, the company shall perform its own works (hereinafter referred to as "work"), such as handling and managing collected personal information, but if necessary, part or all of the work can be deputed to other company selected by the company.


Chapter 5 Cancellation of Membership and Use Limitation

Article 24 (Cancellation of Membership and Use Limitation)
① When the cancellation of a service use agreement, the member shall apply for cancellation to the company either on the website or by a separate method of use set by the company.
② The company may terminate the service contract immediately or suspend the service use without prior notice if the member fails to perform the duties prescribed in Article 19.
③ The company may limit the service use according to the qualification of the member even after the member makes a service contract and receives the ID and password.
④ The company notifies the members who have no service history for 10 years after signing up for the company's memberships, and the service contract may be terminated if there is no answer within the given time set by the company.
⑤ The members may file an objection to the company's actions of paragraphs 2 and 3 of this Article in accordance with the procedures set by the company.
⑥ If the company acknowledges that the objection in paragraph 5 of this Article is justifiable, the company will immediately resume the service use.

Article 25 (Use Limitation of SMS Transmission)
① The company may temporarily suspend the use of SMS transmission service in the following cases. In this case, the company will notify the customer of this in advance.
   - If a report is received from the Ministry of Information and Communication or the Korea Information Security Agency to the company's customer center about the (unauthorized) spam transmission, the company may suspend SMS transmission service for two months.
   - If the same act recurs after the suspension of use above, the company may prohibit the customer from using SMS transmission during the service.
② The member may file an objection to the company's actions of paragraph 1 of this Article in accordance with the procedures set by the company.
③ If the company acknowledges that the objection in paragraph 2 of this Article is justifiable, the company will immediately resume SMS transmission service.

Article 26 (Transfer Prohibition)
The member shall not transfer or give the rights to use the service or other service contract status to others, and all rights and responsibility including the copyright on the post belongs to the writer.


Chapter 6 Compensation for Damages

Article 27 (Compensation for Damages) 
① In case that a member violates the regulations of this terms and conditions and causes damage to the company, the member who violates this terms and conditions shall compensate the company for all damages. 
② In case that the company receives various objections, including claims for damages or lawsuits, from a third party other than the member concerned due to illegal acts or offense against this terms and conditions, the member’s shall make the company be exempted from obligation with own responsibility and expense, and the member shall compensate for all damages caused to the company in case the company is not be exempted from obligation.

Article 28 (Exemption from Liability) 
① If the company is unable to provide the service due to natural disasters or equivalent irresistible force, the company shall be exempted from obligation for the service provision.
② The company shall not be liable for the service use failure caused by the reasons attributable to the members. 
③ The company shall not be liable for the loss of profits expected by the members by using the service, nor shall it be liable for damages caused by data obtained through the service. The company shall not be liable for the information, data, reliability of facts and accuracy posted on the website by the members.
④ The company is not liable for intervention in disputes occurred between members or between members and third parties due to the service, nor is it liable for damages caused by such disputes.

Article 29 (Competent Court) 
① In case of disputes between the company and the members 
in relation to the service use, the company and the members shall sincerely discuss to resolve the disputes.
② If the disputes are not resolved in the discussion in paragraph 1 of this Article, both parties may file an suit at the competent court under the Civil Proceedings Act.
